Article 1: In order to strengthen the management of people coming to Beijing from other places to engage in domestic service work, facilitate the lives of the people, and protect the legitimate rights and interests of both parties, in accordance with the "Beijing Regulations on the Management of Persons Coming to Beijing for Industry and Business", the Regulations are formulated these regulations. Article 2: All foreigners who come to Beijing to engage in domestic service work within the administrative area of ​​​​this city (hereinafter referred to as domestic workers) and residents of this city who hire domestic workers (hereinafter referred to as users) must abide by these regulations.

Domestic service work as mentioned in these regulations refers to household work such as housework, laundry and cooking, caring for the elderly or patients, and babysitting in residential households. Article 3 The Municipal Labor Bureau is the competent authority for the management of household services in this city, and the district and county labor bureaus are responsible for the management and supervision of household services within their jurisdiction. Article 4 The registration and introduction of domestic helpers shall be handled specifically by the domestic helper introduction agencies approved by the municipal, district and county labor bureaus.

Without the approval of the municipal, district or county labor bureau, no unit or individual may engage in profit-making activities of introducing domestic helpers. Article 5 Persons coming to Beijing from other places who apply to engage in domestic service work should go to the domestic service agency to apply for employment registration with the following certificates or certification materials:

(1) Personal ID card and "Temporary Residence Permit";

(2) A recent physical examination certificate issued by a hospital at or above the county level;

(3) "Registration Card for Employment outside the home" issued by the labor administrative department at or above the county level of origin;

(4) Women of childbearing age should hold a "Marriage and Childbirth Certificate" issued by the family planning authority in the place of temporary residence;

(5) Other relevant documents and certification materials. Article 6 For foreigners coming to Beijing who meet the following conditions, the domestic service introduction agency will introduce users and issue the "Employment Permit for Foreigners (Domestic Service)" (hereinafter referred to as the "Employment Permit") uniformly printed by the Municipal Labor Bureau: < /p>

(1) Aged 16 or above;

(2) Good health;

(3) Having a junior high school education or above;

(4) Received vocational training in domestic service work;

(5) All certificates and certification materials are complete. Article 7 The "Employment Permit" is the legal certificate for people coming to Beijing from other places to engage in domestic service work. People coming to Beijing from other places who have not obtained the "Employment Permit" are not allowed to engage in domestic service work.

The "Employment Certificate" is issued per person and cannot be altered, transferred or lent.

If the registration content of the "Employment Certificate" changes, the domestic helper must go to the domestic helper introduction agency to go through the change procedures. Article 8 Users who hire domestic helpers must abide by the following regulations:

(1) Household helpers must be hired through a domestic helper agency or other legal means, and must not be recruited in the illegal labor market;

< p>(2) Personnel holding an "Employment Certificate" must be employed;

(3) A domestic service contract must be signed with a domestic helper;

(4) A household registration book, The head of the household's resident ID card should go to the home service agency to go through contract filing procedures;

(5) Apply for changes to the "Temporary Residence Certificate", "Marriage and Childbirth Certificate" or "Temporary Residence Certificate" or "Marriage and Childbirth Certificate" for the home attendant Register. Article 9 The home service contract (hereinafter referred to as the contract) signed by the user and the home attendant shall include the following main contents:

(1) Specific items of home service work;

(2) ) Contract term;

(3) Service discipline;

(4) Housing and living conditions provided by users for home attendants;

(5) Labor remuneration ;

(6) Personal accident insurance for domestic helpers;

(7) Legal liability for breach of contract;

(8) As agreed upon by both parties something else.

The home service contract is in triplicate, with one copy each held by the user, the home attendant and the home attendant introduction agency. Article 10 If any of the following circumstances occurs, the home attendant may terminate the contract and go through the contract termination procedures at the home attendant introduction agency where the original contract was recorded:

(1) The user fails to pay labor remuneration as stipulated in the contract ;

(2) The user requests additional home service items without the consent of the home attendant;

(3) The user infringes upon the personal rights, property rights and other legitimate rights and interests of the home attendant;< /p>

(4) Users force home attendants to engage in activities that violate laws, regulations, rules, policies and social ethics. Article 11 If any of the following circumstances occurs, the user may terminate the contract and go through the contract termination procedures at the home attendant agency where the original contract was recorded:

(1) The home attendant is ill or injured outside of work, Cannot continue to engage in domestic service work;

(2) The domestic waiter fails to perform the service items stipulated in the contract;

(3) The domestic waiter engages in activities that violate laws, regulations, rules, policies and Social ethics activities. Article 12 If both parties to the contract need to change the content of the contract, they should go to the home service agency where the original contract was recorded to go through the contract change procedures.

Article 13 After the contract expires or is terminated in accordance with the law, if a domestic helper continues to engage in domestic service work, he must go to the domestic service introduction agency to go through the relevant procedures again with the "Employment Certificate". For those who no longer engage in domestic service work, the domestic service agency will be responsible for withdrawing the "Employment Certificate".

Household attendants who have been engaged in domestic service work for less than 3 years are not allowed to engage in other industries.
