Article 1: In order to ensure road traffic safety, encourage technological progress, and accelerate the construction of a resource-saving and environment-friendly society, in accordance with the "Road Traffic Safety Law of the People's Republic of China" and its implementation regulations, "China The Law of the People's Republic of China on the Prevention and Control of Air Pollution and the Law of the People's Republic of China on the Prevention and Control of Noise Pollution formulate these regulations.

Article 2: Based on the use, safety technology, and emission inspection status of motor vehicles, the state implements mandatory scrapping of motor vehicles that meet scrap standards.

Article 3 Commerce, public security, environmental protection, development and reform and other departments shall, in accordance with their respective responsibilities, be responsible for the supervision and management of the recycling and dismantling of scrapped motor vehicles and the implementation of mandatory scrapping standards for motor vehicles.

Article 5 The service life of various types of motor vehicles are as follows:

For small and micro taxi passenger vehicles (except pure electric vehicles) and motorcycles, the relevant departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may formulate regulations that are stricter than the above-mentioned service life based on local actual conditions, but small , Micro taxi passenger cars must be no less than 6 years old, three-wheel motorcycles must be no less than 10 years old, and other motorcycles must be no less than 11 years old.

There is no service life limit for small and micro non-commercial passenger vehicles, large non-commercial cars, and wheeled special mechanical vehicles.

The starting date of the service life of a motor vehicle is calculated based on the registration date. However, if the registration formalities have not been completed for more than 2 years since the date of leaving the factory, the starting date will be calculated based on the date of leaving the factory.

Article 6 Motor vehicles that change the nature of use or transfer registration shall have a service life and be scrapped in accordance with the following relevant requirements:

(1) Commercial passenger vehicles and non-commercial passenger vehicles If converted to each other, they shall be scrapped in accordance with the regulations for commercial passenger vehicles. However, if small and micro non-commercial passenger vehicles and large non-commercial sedans are converted into commercial passenger vehicles, the cumulative service life shall be calculated according to the formula listed in Appendix 1 of these regulations, and No more than 15 years;

(2) Different types of operating passenger vehicles are interchangeable and scrapped according to stricter service life regulations;

(3) Small and micro taxi passenger vehicles and motorcycles that need to be transferred out of the province, autonomous region, or municipality where they are registered shall be scrapped according to the stricter service life regulations;

(4) Dangerous goods transport trucks, semi-trailers and other trucks , semi-trailers that are converted into each other shall be scrapped in accordance with the regulations on dangerous goods transport trucks and semi-trailers.

Motor vehicles whose service life is within 1 year (inclusive) of the requirements of these regulations may not change the nature of use, transfer ownership, or transfer out of the prefecture-level administrative area where the registration place belongs.

Article 7 The state guides motor vehicles that have reached a certain mileage to be scrapped.
